1. Definitions

2.2 The Service may include loading of Waste, sweeping of cleared areas, sorting of recyclable materials, and transportation of Waste to licensed facilities, as agreed at the time of booking.
2.3 Services are usually offered within the local and surrounding areas, but the Company reserves the right to refuse bookings outside its normal operating area or to apply additional charges for extended travel.
2.4 The Company does not provide specialist services such as asbestos removal, clinical waste collection, or hazardous chemical disposal unless expressly agreed in writing and subject to additional terms and charges.
3. Booking Process
3.1 Bookings can be made by telephone, email, or other communication channels made available by Rubbish Removal Bromley.
3.2 When making a booking, the Customer must provide accurate and complete information, including the Site address, access details, description and approximate volume or weight of Waste, and any relevant restrictions such as parking or loading limitations.
3.3 Any quote given prior to the collection is based on the information supplied by the Customer. If, upon arrival, the actual Waste, access conditions, or Site requirements differ from the information provided, the Company may adjust the price, amend the scope of the Service, or refuse to complete the Service.
3.4 Bookings are subject to availability. Any time or date given for arrival is an estimate only and not guaranteed. The Company will make reasonable efforts to attend within the agreed time window but shall not be liable for any losses caused by delay or rescheduling outside its reasonable control.
3.5 A Contract is formed when the Customer confirms the booking and the Company accepts it, either verbally or in writing, and confirms the collection arrangements.
4. Pricing and Quotes
4.1 Prices may be based on factors such as volume of Waste, weight, labour time, distance, type of material, and any additional services required.
4.2 Any quote given prior to the Service is an estimate only and may be revised if:
a) the Waste is more than described by the Customer;
b) the Waste includes items that are heavier, denser, or more difficult to handle than anticipated;
c) there are access issues requiring extra labour or time; or
d) additional services are requested by the Customer at the time of collection.
4.3 The Company will inform the Customer of any change in price before proceeding. If the Customer does not accept the revised price, the Company may cancel the Service, and the Customer may be liable for a call-out or cancellation charge if the crew has already attended the Site.
4.4 All prices are stated in pounds sterling and may be subject to applicable taxes. Any taxes will be clearly identified in the price where legally required.
5. Payment Terms
5.1 Payment is due on completion of the Service unless otherwise agreed in advance. The Company may, at its discretion, require payment in full or in part before commencing the Service.
5.2 Rubbish Removal Bromley accepts commonly used payment methods such as cash, debit or credit card, or bank transfer, subject to availability at the time of booking or collection.
5.3 Where the Customer is a business or organisation with an agreed account, payment terms will be as set out in the account agreement. If no specific terms are agreed, payment shall be due within 14 days of the invoice date.
5.4 If the Customer fails to pay any amount due, the Company reserves the right to charge interest on overdue sums at the statutory rate and to recover all reasonable costs incurred in pursuing the debt, including legal and collection fees.
5.5 The Company may withhold or suspend Services to any Customer with outstanding payments and may refuse further bookings until all amounts owed are settled.
6. Cancellations and Rescheduling
6.1 The Customer may cancel or reschedule a booking by giving notice to the Company as early as possible.
6.2 Cancellations made more than 24 hours before the agreed arrival time will usually not incur a charge, unless the Company has incurred specific costs on behalf of the Customer.
6.3 Cancellations made within 24 hours of the agreed arrival time may incur a cancellation fee, which may include any call-out fees, administration costs, or other expenses reasonably incurred by the Company.
6.4 If the crew attends the Site and is unable to carry out the Service due to reasons outside the Company’s control, such as lack of access, incorrect address, absence of an authorised person to grant entry, or breach of these Terms and Conditions by the Customer, the Company may treat this as a same-day cancellation and charge a fee.
6.5 The Company reserves the right to cancel or reschedule the Service due to circumstances beyond its reasonable control, including severe weather, traffic disruption, vehicle breakdown, staff illness, or legal or regulatory requirements. In such cases, the Company will seek to offer a new appointment but shall not be liable for any consequential loss.
7. Customer Responsibilities
7.1 The Customer must ensure that the Site is safe, accessible, and suitable for the Service to be carried out. This includes providing clear access to the Waste, ensuring adequate parking arrangements, and complying with any local rules relating to loading and parking.
7.2 The Customer is responsible for obtaining any necessary permissions, permits, or authorisations required for vehicle access, loading, or temporary stopping at or near the Site, unless otherwise agreed.
7.3 The Customer must not present for collection any Waste that is hazardous, toxic, explosive, or otherwise unsuitable for handling by the Company unless expressly agreed and properly packaged and labelled in accordance with applicable regulations.
7.4 The Customer shall ensure that no items intended to be kept are mixed with the Waste. The Company shall not be liable for the removal of any item mistakenly included as Waste.
7.5 The Customer agrees to cooperate with the Company’s staff, including following any safety instructions given and ensuring that children, pets, and non-essential persons are kept away from the working area.
8. Waste Types and Exclusions
8.1 The Company generally accepts most household, garden, and non-hazardous commercial Waste, such as furniture, white goods, packaging, green waste, office rubbish, and general clutter.
8.2 The following items are typically excluded from standard Service unless otherwise agreed in advance and subject to additional charges and conditions:
a) asbestos and materials containing asbestos;
b) medical, clinical, or biological waste;
c) chemicals, solvents, paints, oils, and fuels;
d) gas bottles and pressurised containers;
e) hazardous electrical or electronic equipment beyond normal household appliances;
f) radioactive, explosive, or highly flammable materials.
8.3 If such items are discovered in the Waste without prior disclosure, the Company may refuse to remove them, adjust the price, or suspend the Service. The Customer may be charged for any additional handling, safety measures, or disposal costs incurred.
9. Compliance with Waste Regulations
9.1 Rubbish Removal Bromley operates in accordance with applicable waste management laws and regulations in the United Kingdom, including the duty of care requirements for the handling, transport, and disposal of controlled waste.
9.2 The Company will take reasonable steps to ensure that Waste is transferred only to authorised sites and carriers and that it is processed, recycled, or disposed of responsibly.
9.3 Where legally required, the Company will produce or retain appropriate documentation for waste transfers, which may include details of the Customer, the type of Waste, and the destination facility.
9.4 The Customer agrees not to do anything that would cause the Company to be in breach of any legal or regulatory obligation relating to Waste, including misdescribing the nature of the Waste or presenting prohibited materials as general rubbish.
10. Liability and Insurance
10.1 The Company will exercise reasonable care and skill when carrying out the Service. However, the Customer accepts that some risk of minor damage may be inherent when moving bulky items through confined spaces or when clearing waste from challenging areas.
10.2 The Company’s liability for damage to property caused by negligence shall be limited to the repair or replacement cost of the damaged item, taking into account age, condition, and fair wear and tear, and shall in any event be limited to a reasonable amount having regard to the value of the Service.
10.3 The Company shall not be liable for any indirect or consequential loss, including loss of profit, business interruption, or loss of opportunity, arising out of or in connection with the Service or these Terms and Conditions.
10.4 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other liability that cannot be excluded by law.
10.5 The Customer is responsible for ensuring that any fragile or high-value items are identified and kept separate from the Waste. The Company accepts no liability for items removed in error where they were not clearly identified and segregated by the Customer.
10.6 Rubbish Removal Bromley maintains appropriate public liability insurance and, where relevant, employer’s liability insurance for the activities it undertakes.
11. Access, Parking, and Charges
11.1 The Customer must provide suitable access for the Company’s vehicle and staff to attend the Site and load the Waste safely.
11.2 Any parking costs, permits, or fines incurred as a direct result of the Customer’s instructions, or arising from inadequate or misleading information provided by the Customer, may be charged to the Customer.
11.3 If the Site access requires the crossing of third-party land, use of shared driveways, or entry through managed premises, the Customer must ensure that any necessary permissions are in place. The Company shall not be responsible for any claims arising from lack of such permissions.
12. Time Limits and Waiting
12.1 Standard quotes are based on a reasonable loading time according to the size of the collection. If additional time is required due to factors beyond the Company’s control, such as poor access, poorly prepared Waste, or delays caused by the Customer, waiting time charges may apply.
12.2 Any such charges will be notified to the Customer as soon as reasonably practical and must be paid in accordance with the Company’s payment terms.
13. Complaints and Disputes
13.1 The Company aims to provide a reliable and professional Service. If the Customer is dissatisfied for any reason, they should contact the Company as soon as possible to raise a complaint.
13.2 The Company will investigate complaints promptly and seek to resolve them fairly, which may include inspecting the Site, reviewing documentation, and discussing the matter with the Customer.
13.3 If a dispute cannot be resolved through informal discussions, the parties may consider formal dispute resolution methods such as mediation or arbitration, without affecting their rights to pursue claims in court.
14. Data Protection and Privacy
14.1 The Company may collect and process personal data about Customers, such as names, contact details, Site addresses, and payment information, for the purpose of providing the Service, administering bookings, and complying with legal obligations.
14.2 The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom and will take reasonable steps to protect it against unauthorised access, loss, or misuse.
14.3 The Customer has rights in relation to their personal data, including rights of access and correction, subject to legal conditions and exemptions.
15. Variation of Terms
15.1 Rubbish Removal Bromley reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that Contract.
15.2 Any variation to these Terms and Conditions requested by the Customer shall only be binding if agreed by the Company in writing.
16. Severability
16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted.
16.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims.
18. Entire Agreement
18.1 These Terms and Conditions, together with any agreed booking details or written variations, constitute the entire agreement between the Company and the Customer and supersede any prior discussions, correspondence, or understandings relating to the subject matter.
18.2 The Customer acknowledges that they have not relied on any statement, promise, or representation not expressly set out in these Terms and Conditions.
